Contract Terms

1.

The publisher reserves the right to censor all advertisements and /or to reject any advertisements.

2.

The publisher will not be liable for any loss or damage owing to the failure of publication of any advertisement from any cause whatsoever, nor does it accept liability for errors in any advertisements published, nor its failure to appear on a specified date.

3.

The agency and/or advertiser is responsible for the entire contents and subject matter of the advertisements published. The publisher accepts no responsibility whatsoever for the contents and subject matter of the advertisements. In view of the publisher's acceptance of such advertisements for publication, the agency and/or advertiser will indemnify the publisher without limitation against any claim or suit arising from the contents and subject matter of the advertisement. The publisher reserves the right to insert the word “advertisement” in advertising that simulates editorial format and style.

4.

If instructions to replace existing creative material are not received by the copy deadline the publisher reserves the right to repeat a previous advertisement or other discretionary copy of the same size, and the advertiser or agency will be liable for the space cost at the original contracted rates.

5.

No Cancellation for any bookings after signing the contract

Advertising contracts are only valid if accepted and confirmed by publisher either in writing or by returning to the advertiser or agency, assigned copy of the space contract or insertion order. The publisher is not bound by verbal bookings unless these are followed up and confirmed in writing within two weeks, from date of bookings.

7.

By confirming the advertising booking in Design Anthology, the advertiser or agent agrees to accept the terms and conditions stated in the media kit.

8.

By placing an order, the advertiser or agent agrees to accept the above conditions of business. Stipulations on advertising orders which differ from the above are not considered binding unless expressly acknowledged in writing by the publisher.

9. NON-STANDARD ADVERTISING

The rates quoted are for basic process colours (CMYK). Rates for special colours, gatefolds and other non-standard advertisements will be quoted on a case by case basis.

10. DIGITAL MATERIALS

The publisher reserves the right to retain the artwork for up to 4 weeks upon publication of the advertisement.

11. PAYMENT (FOR LOCAL ADVERTISERS)

You agree to pay the amount due per issue upon publication. Due within 30 days from publication. All payments are to be made in HKD currency. Cheques should be crossed and made payable to Fifth Black Media Ltd.

12. PAYMENT (FOR OVERSEAS ADVERTISERS)

You agree to pay the total ad amount upon the contract signed.

13. LATE PAYMENT

A 5% late payment interest will be charged on all payments exceeding 30 days from date of invoice.

14.

This contract is executed between respective representatives of the publishing company and the advertiser and should be honoured despite an eventual change.

Please email studio@fifthblack.com to submit your artwork or for production or technical support.

When supplying advertising material, please include the magazine name and issue number on the uploaded file. This will assist in keeping track of your advertisement. Ensure that the order of consecutive advertisements and left/right hand pages on double page spreads are noted in the material instructions. Please contact production prior to sending revised files and when sending revised files add an ‘R’ at the end of the file name.


acceptable media

High-resolution (175-line screen & minimum 300 dpi). Acceptable formats include pdf, InDesign, TIFF or EPS files in CMYK. Files to be supplied as single pages.


colour proofs

For accurate colour reproduction, all advertising material must be accompanied by a 3DAPv3 proof created from the supplied file at 100%. In order to verify that a proof is in compliance with the 3DAPv3 proofing requirements, each proof must be supplied with the appropriate 3DAPv3 endorsed control strip printed next to
the advertisement.

No responsibility will be taken for print quality or colour reproduction when a 3DAPv3 certified digital-approved proof is not supplied.Advertising material supplied without a proof may be proofed by Design Anthology at the advertiser’s expense. This proof will be supplied to our printers only.


page layout

All advertising material must include a 5mm bleed on all outside edges. No text or critical elements should appear within 10mm of the spine, as anything in this space may be optically lost within the spine binding. Using double imaging is at the discretion of the client/agency, as it is not ideal for all pages within the magazine. If specifications and measurements are required for double imaging, contact production prior to sending advertising material.

Ensure that all text and logos are supplied to the correct type/design area specifications.


spreads

The Publisher cannot guarantee the alignment of text or design along the centre fold line as adjoining pages can shift up to 5mm in the binding process of some copies.


images

Images to be supplied in CMYK format. RGB or LAB files will be automatically converted, but the Publisher takes no responsibility for the accuracy of such conversions. 4-colour black and white images should use a UCR separation.

For best results, images must be supplied at 100% scaling, 300dpi and with appropriate separation profile. The Publisher accepts no responsibility for the reproduction of imagery that does not meet these requirements.

Design Anthology will need to be notified if the resolution of an image is intentionally supplied lower than 300dpi.


colour / type / lines / borders

The total ink limit is 280%. Registration colour in the swatches palette should never be used as it is made up of 100% of each colour.

Solid black panels should be made up of rich black (100% black and 50% cyan). White elements to be set to knockout.

All fonts must be embedded into the PDF file.

Due to the trim and binding variance, even distances from trim to borders may vary during the print run; therefore, we recommend that solid borders be supplied no thinner than 8mm and key lines sit no less than 8mm in from the trim.

disclaimer

While Design Anthology is committed to producing a magazine of the highest calibre and will ensure advertising material is reproduced as intended, the responsibility is firmly with the client/agency to supply advertising material according to our specifications. No responsibility will be taken if advertising material is not supplied according to Design Anthology’s specifications.

Design Anthology cannot accept requests to modify supplied advertising material. Advertising material will be archived for three issues and advertising-related correspondence, i.e. MIs, emails confirming repeats, etc. will be archived for six months. Advertising material must be delivered on time so that quality checking procedures can take place.

Design Anthology reserves the right to refuse any advertising material. Advertisers may not cancel or change orders for, or make changes in, advertising after the booking deadline.

Advertisers may postpone an advertisement for one issue (i.e. three months) on one occasion if Design Anthology receives the request before the booking deadline.

Agreement to advertise in Design Anthology constitutes acceptance of these terms and conditions, which are legally binding and of which advertisers will be deemed to have informed themselves.
